Legal basis & training obligation

What's the legal basis for this course?

Safety training is mandatory in Germany for all companies whose employees lift or carry loads. This requirement is based on several interrelated regulations. Section 12 of the Occupational Safety and Health Act (ArbSchG) requires every employer to provide their employees with sufficient and appropriate instruction on safety and health protection, both upon hiring and regularly thereafter. DGUV Regulation 1 (Section 4) specifies the requirements for statutory accident insurance and mandates instruction at least once a year. Specifically for lifting and carrying, § 4 of the Load Handling Ordinance (LasthandhabV) applies: This regulation requires that you instruct your teams on the proper handling of loads and the risks associated with incorrect lifting. Documented instruction helps you fulfill these obligations in a verifiable manner and protects the health of your teams in their daily work.

Who must be trained?

Employees who lift, carry or move loads as part of their work.

When is training required?

  • At least once a year
  • Before taking up employment or a change of tasks that involves lifting and carrying
  • Additionally on special occasions, e.g. introduction of new equipment or work processes, after an injury related to lifting or carrying
